There are living microorganisms on the deep seabed which have adapted to the local extreme environmental conditions and, therefore, have developed unique genetic characteristics. It is contentious among States who is authorised to exploit and utilise such genetic resources. This fundamental question remains unanswered by existing treaties of international law. However, the principle of the common heritage of mankind has meanwhile evolved into customary international law.
